What if my workers’ compensation claim has been denied by the insurance company?

If your workers’ compensation case was denied, you should have received a written notice from the insurance company stating the basis for the Denial of your case. There is no more critical time contact TURCHIN LAW than this moment.

An experienced attorney willing to fight for you can ensure that you get proper benefits while waiting to dispute your injury, including disability benefits to pay up to 2/3 of your average weekly earnings up to a maximum amount as well as medical treatment with a physician of your choice. Your attorney can also conduct depositions and request records as well as interview witnesses to prepare for presenting your case at the Workers’ Compensation Appeals Board in front of a Judge to establish for the Court that you are entitled to workers’ compensation benefits. During this period before a Judge rules on the validity of your injury claim, the benefits that you receive are not your responsibility to pay back even in the event that you for some reason you lose your case.

Please note that the vast majority of cases that are initially denied by the insurance company ultimately settle for an amount agreed to by the injured worker and the insurance company/employer. In those cases that proceed to Trial, the success rate at TURCHIN LAW is well over 90% in establishing that you have a valid claim requiring that you be paid benefits to compensate you for your injuries until the conclusion of your case. Having strong legal representation from a firm such as TURCHIN LAW is a critical aspect of establishing the legitimacy of your work-related injury.
